Acceptance of Terms

By downloading, installing, or using WindRider ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.

WindRider is provided by WindRider MotoNav ("we", "us", or "our"). These terms constitute a legally binding agreement between you and us.

Age Restrictions

WindRider is not intended for children under the age of 13. If you are under 13, you may not use the App. If you are between the ages of 13 and 18 (or the age of majority in your jurisdiction), you may use the App only with the consent and supervision of a parent or guardian who agrees to be bound by these terms.

By using the App, you represent and warrant that you are at least 13 years old and have the legal capacity to enter into this agreement.

Use of Service

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the App will be uninterrupted, error-free, or completely secure.

You agree to use the App only for lawful purposes and in accordance with these Terms of Service and all applicable laws and regulations.

You may not:

• Use the App for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to the App or its related systems
• Interfere with or disrupt the App or servers connected to the App
• Reverse engineer, decompile, or disassemble the App
• Remove or alter any copyright, trademark, or other proprietary notices
• Use the App in any way that could damage, disable, or impair the App or interfere with any other party's use of the App

Safety and Navigation Disclaimer

IMPORTANT SAFETY WARNING: WindRider is a navigation and tracking tool. It is not a substitute for safe riding practices, proper judgment, or compliance with traffic laws.

You acknowledge and agree that:

• You are solely responsible for your safety and the safety of others while riding
• You must always prioritize safety over following navigation instructions
• You must comply with all applicable traffic laws, regulations, and road signs
• You must not use the App in a way that distracts you from safe riding practices
• Navigation instructions may not always be accurate, complete, or current
• Road conditions, traffic, weather, and other factors may affect route safety
• You should always verify routes and directions before and during your ride
• The App's motion analytics and safety insights are informational only and do not guarantee safety

We strongly recommend:

• Using a proper motorcycle mount for your device
• Using voice navigation to minimize visual distraction
• Pulling over safely if you need to interact with the App
• Keeping your attention on the road and traffic conditions at all times
• Not using the App while riding if it causes distraction

Liability and Indemnification

LIMITATION OF LIABILITY: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the App
• Any errors or omissions in the App's content or functionality
• Any interruption or cessation of transmission to or from the App
• Any bugs, viruses, or other harmful code that may be transmitted through the App
• Any loss or damage resulting from your reliance on navigation instructions or route information
• Any accidents, injuries, or damages resulting from your use of the App while riding

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF OR INABILITY TO USE THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US, IF ANY, FOR ACCESSING THE APP.

INDEMNIFICATION: You agree to indemnify, defend, and hold harmless WindRider MotoNav, its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from your use of the App, your violation of these Terms of Service, or your violation of any rights of another party.

Intellectual Property

The App, including its original content, features, and functionality, is owned by WindRider MotoNav and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use in accordance with these Terms of Service.

You retain ownership of any content you create using the App (such as routes and tours), but you grant us a license to use, store, and process such content to provide the App's services.

Privacy

Your use of the App is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your information.

Modifications to the App

We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App.

Changes to Terms

We may update these Terms of Service from time to time. We will notify you of any material changes by posting the new Terms of Service on this page and updating the "Last updated" date.

Your continued use of the App after any changes to these Terms of Service constitutes your acceptance of the new terms. If you do not agree to the new terms, you must stop using the App.

Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms of Service.

Upon termination, your right to use the App will cease immediately. You may terminate your use of the App at any time by uninstalling it from your device.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms of Service or the App shall be subject to the exclusive jurisdiction of the courts of Germany.

Severability

If any provision of these Terms of Service is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
